Buying & Selling Hotels

Commercial Aspects

An experienced solicitor with local knowledge is invaluable when purchasing a hotel, guest house or bed & breakfast business.

Not only does the solicitor need to be a competent conveyancer, but they also need to have the necessary knowledge to deal with the legal aspects of the purchase of the business which involves complex issues such as VAT and apportionment of price to maximise fiscal advantages. We can also advise you on incorporation of your business and funding arrangements.

We are sufficiently expert in our field to ensure that any issues relating to employment or licensing matters are referred to the appropriate specialists within the firm.

Employment Issues

When you buy a hotel or guest house it is likely that you will need staff to help you run it. Employers are subject to a significant legal and regulatory burden covering the employment of staff. Many employers find it impossible to keep abreast of changes.

We provide regular newsletters upon changes in legislation and regulations, and how they will affect your business.

We can help you with such problems as:

  • The consequences of taking over existing staff under the Transfer of Undertakings Protection of Employees Regulations (TUPE)
  • Contracts of Employment
  • Disciplinary and Grievance procedures
  • Maternity Rights
  • Restrictive covenants
  • Employment law is a legal minefield—even for the smaller employer. Protect yourself by contacting us at the first opportunity.

Licensing

Do the premises you are buying already have a licence? If so, you will need to transfer or vary the licence before you are permitted to sell alcohol.

If not already licensed, do you want to apply for a new licence?

We can advise you on all aspects of licensing law and deal with all the relevant applications you will need so that you can sell alcohol once you take over.

Terms and Conditions

All supplies of goods and customer bookings are governed by terms of contract. Do your terms protect you? We can advise upon wording to safeguard your position.
